Terms of Use

These terms are a contract between you and Pixel Kingdom Wars ("we", "us"), the independent project that develops the game. Please read them. If you do not accept them, do not play.

The short version

This summary is not the contract, but it is accurate. The sections below are.

1. Who we are

The game is provided by Pixel Kingdom Wars, an independent development project. That is the party you are contracting with. For any question, complaint or legal notice, write to support@pixelkingdomwars.com — it is the route for every request in these terms and in our Privacy Policy.

We are an independent developer. We are not affiliated with, sponsored by, or endorsed by Solana Mobile, Solana Labs, the Solana Foundation, or any wallet, exchange or infrastructure provider named in these terms.

2. Accepting these terms

You accept these terms when you sign in, connect a wallet, or continue to play. The game does not currently present them to you for acceptance: they are published here and linked from pixelkingdomwars.com, and it is on you to read them. If we materially change them we will publish the change on this page and announce it on pixelkingdomwars.com and our official channels before it takes effect. Continuing to play after the effective date is acceptance; if you do not accept, stop playing and ask us to close your account.

3. Who may play

By playing you represent that:

We do not operate an age-verification check and we do not ask your date of birth, so nothing verifies your age — playing is your representation that you are 18 or over. If we learn that an account belongs to someone under 18, we will withdraw its access and delete the data we hold. If you are a parent or guardian and believe your child has an account, write to support@pixelkingdomwars.com and we will do the same.

The game is presently in closed alpha and access is limited to invited wallets. We may grant, refuse or revoke access to the alpha at our discretion.

4. This is unfinished test software on a test network

The game is a closed alpha. It is provided for testing and evaluation. It contains defects, it will change, and it may be unavailable.

The game runs on Solana devnet. Devnet is Solana's public test network. Devnet SOL and every devnet token, item, currency and land deed in the game are test artifacts. They are obtained free from public faucets and from playing. They cannot be bought with real money and cannot be redeemed for real money. Devnet may be reset at any time by the network itself, outside our control.

At any time, without notice and without compensation, we may:

Expect this. It is what alpha means.

5. No promise of future value

We make no commitment, and you should form no expectation, that any account, balance, item, land deed, rank or other in-game state will be migrated, mirrored, snapshotted, converted, honoured, rewarded or airdropped to any future version of the game, any mainnet deployment, any token, or any successor product. Nothing in the game, on our website, in our chat channels or in any communication from us creates such a promise.

Nothing we offer is an investment, a security, a share, a note, a unit, a fund or any other financial instrument. Nothing we offer entitles you to profit, yield, revenue, dividends, governance rights or any claim against us. Nothing we say is financial, investment, legal, tax or accounting advice, and nothing is an offer, solicitation or recommendation to buy or sell anything. We are not a broker, dealer, exchange, custodian, money transmitter or adviser. You are responsible for your own tax position.

6. Your wallet and your keys

You can play with a self-custody wallet you already control, or with an embedded wallet created for you through our login provider, Privy.

We will never ask you for your seed phrase, recovery phrase or private key — by any channel, for any reason. We will never message you first asking you to connect a wallet, sign a transaction, or claim a reward. Anyone who does is attempting to defraud you. Our official channels are the ones linked from pixelkingdomwars.com.

7. Your account

You are responsible for everything done through your account and wallet. Do not share, sell, rent, lend or transfer account access. Tell us at support@pixelkingdomwars.com as soon as you suspect your account is compromised; we may suspend an account we reasonably believe has been taken over.

8. Your licence to play

We grant you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to use the game client and play, for your own private entertainment. That is all it is: a licence, not a sale.

All rights in the game — its code, art, audio, characters, names, systems and text — belong to us and our licensors. You may not copy, republish, sell or redistribute the game's assets, reverse engineer or decompile the client, create derivative works from it, or operate a modified or unofficial client or server.

9. In-game items, currencies and balances

Shards, Pixel Kingdom Gold (KEEP), items, troops, buildings, progression and every other in-game balance are a licensed entitlement to use features inside the game. They carry no monetary value, are not redeemable for cash, and are transferable only where the game itself provides a way to transfer them. Where we hold devnet tokens against your balance we hold them to run the game — section 10 — not as a deposit and not as stored value, and they are not your property.

Section 4 applies to all of them.

Our server is authoritative. Your balances and progress are records held on our servers. Where an on-chain record and our server record disagree, our server record governs what happens in the game, and we may re-sync, invalidate or decline to recognise an on-chain record that conflicts with it. No token or on-chain record entitles you to a game outcome our server does not grant.

10. Balances we hold for you

KEEP that you deposit, earn or win is recorded in a ledger on our servers, and the matching devnet tokens sit in wallets we control. That is custody, and we would rather name it: until you withdraw, what you have is an entry in our ledger, not tokens in your own wallet.

Withdrawing moves KEEP out of our custody to a Solana address you name. How it works:

The fee, the cooldown, the cap and the minimum are game-balance numbers and we may change them; the current values are shown in the game's withdrawal screen. Once a week we publish an on-chain summary of what players are owed, and you can ask us for proof that your balance is included in it.

We pay no interest, and we are not a bank, a custodian for regulatory purposes, an exchange or a money transmitter. If we withdraw your access or shut the game down, we do not promise to pay out a held balance: devnet KEEP has no monetary value, and section 4 means it may be reset or removed entirely. Do not put anything you care about into custody.

11. Land deeds

A land deed is a devnet NFT recording an in-game entitlement to occupy and use a plot inside the game, for as long as we operate the game.

A deed is not: real property, real-world land, a share, security, investment, note or financial instrument; equity; a revenue share; a governance right; a claim against us; or a promise of yield, appreciation, scarcity, or the continued existence of the plot or any mechanic attached to it. The "Country" and map location on a deed describe a position you chose on a stylised in-game globe. They are not a record of where you are in the real world.

Every deed carries a 5% creator royalty, paid to us. It is written into the token when the deed is minted, and marketplaces that honour royalties pay it to us on each secondary sale. The blockchain does not enforce it — a marketplace that ignores royalties pays nothing — and because it is stamped at mint, changing the rate does not change deeds already in circulation.

Holding the deed token does not give you the artwork. We keep all copyright in the deed art and metadata, and grant you only a personal, non-exclusive, non-commercial, revocable licence to display the image associated with your own deed.

Deed images and metadata are served from hosting we control and are generated dynamically from live game state. They will change as the game changes, and may become unavailable. The token is a pointer; we do not guarantee what it points at will persist.

12. Trading between players

Where the game lets you list or buy an item from another player, payment happens on-chain between the two wallets in devnet SOL, and we take a 5% fee. The buyer signs a single transaction that pays the seller 95% and our fee treasury 5%, and the sale does not settle unless that exact split lands — so we do have a commercial interest in the trade. What we do not do: hold the funds, set the price, guarantee the trade, or reverse it. A transferred deed or item carries exactly the same entitlement, and exactly the same reset and shutdown risk, as it did before.

You must not use the game or its marketplace to launder money or finance terrorism, to create or trade counterfeit assets, to manipulate prices or fake trading activity, to raise funds for any business, protocol or platform, or to promote, market or advertise any token or digital asset.

13. Randomised rewards

Some items are awarded by chance — most notably daily drops from the Gold Forge on land you hold. These are earned by playing. They are not sold, cannot be bought with real money, and are capped per plot per day. Outcomes are random and no particular outcome is guaranteed. Drop rates are game balance and we may change them.

14. Fair play

You must not:

Security research: if you find a vulnerability, report it privately to support@pixelkingdomwars.com first. We will not treat good-faith research as a breach of this section, provided you do not access other players' data, do not degrade the service for others, and give us a reasonable chance to fix it before disclosing.

15. Bugs and exploits

If you find a defect, report it — do not farm it. Using a bug for advantage is a breach of these terms even though the bug is our fault. Where an exploit has been used, we may reverse the transactions, remove the items and balances it produced, and roll back the affected accounts, without compensation.

16. Chat, names and other content you create

You are responsible for everything you write or upload: your display name, clan name and tag, chat messages, and your profile picture. You confirm you have the rights to what you upload.

You grant us a worldwide, royalty-free, non-exclusive licence to host, store, copy, display and moderate that content for the purpose of operating the game, and to show it in screenshots or recordings of gameplay. You keep ownership of it, and the licence ends when the content does.

You must not create, upload or send content that:

What we provide, and what we do not. In-game you can report a chat message and block another player so you stop seeing them. We review reported content, and we can delete or redact messages and mute an account in chat. We can also reclaim or change a name, and withdraw an account's access to the alpha — during the closed alpha we do both of those by hand. We do not pre-screen every message, name or profile picture before it appears, and we do not run an automated profanity filter, so please report what you see. To report a display name, clan name or profile picture, or anything you cannot report in-game, write to support@pixelkingdomwars.com.

We may reclaim, rename or remove any name or content at any time, including for impersonation or name-squatting.

17. Enforcement

Where you breach these terms we may, proportionately to what happened: warn you; remove or redact content; reclaim or reset a name; mute you in chat; remove items or balances; roll back progress; withdraw your access to the alpha; suspend or ban your account; or refuse you future access. During the closed alpha most of these are done by hand rather than by tooling. We are not obliged to compensate you or to preserve your data.

Where we act against your account or remove your content, we will give you the reason if you ask, and you can contest it by writing to support@pixelkingdomwars.com. We review appeals ourselves rather than by automated decision, and reply as soon as we reasonably can.

18. Third-party services and blockchain risks

Playing involves services we do not control: the Solana network and its validators, RPC providers, wallet software, our login provider Privy, app stores and app-store platforms, and our hosting and infrastructure providers. Your use of those services is governed by their own terms and privacy policies.

Those services can fork, halt, congest, raise fees or go down; smart contracts can be defective, including ours; transactions can fail, stall or never finalise; and assets can be lost permanently through key loss, error or fraud. We are not liable for any of it, and you accept those risks as a condition of playing.

19. Support and refunds

We take no real money. No part of the game is sold for money, there are no in-app purchases, and there is nothing for us to refund. The fees in sections 10, 11 and 12 are taken in devnet assets, which are not money. If we ever introduce paid content, we will sell it only through the platform's own purchase system and will publish a refund policy before we do.

20. Feedback

The point of a closed alpha is feedback, so please send it. Any bug report, idea or suggestion you send us may be used freely, without restriction, obligation, attribution or payment. You are welcome to stream, record and publish footage of the alpha.

21. Ending it

You can stop playing at any time. To close your account and have your data deleted, write to support@pixelkingdomwars.com — our Privacy Policy explains exactly what we erase and what, being on a public blockchain, we cannot.

We may suspend or terminate your access for breach of these terms, or for any reason during the closed alpha, on notice where practical. When access ends: your licence ends; your in-game balances and progress, including anything we hold in custody under section 10, are lost without compensation; and any tokens already in your wallet stay in your wallet but may stop working or being recognised by the game.

Sections 5, 8, 9, 10, 11, 20 and 22 to 28 survive termination. The licence you granted in section 16 survives only for content you have not deleted.

22. Changes to these terms

We may change these terms. The "Last updated" date at the top always reflects the current version. For material changes we will publish them on this page and announce them on pixelkingdomwars.com and our official channels before they take effect, and your remedy if you disagree is to stop playing and ask us to close your account.

23. Disclaimer of warranties

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT YOUR ACCOUNT, PROGRESS, ITEMS, BALANCES OR ON-CHAIN RECORDS WILL BE PRESERVED.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. If you are a consumer, your non-excludable statutory rights are unaffected.

24. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, ACCOUNT PROGRESS, OR ANY CLAIMED VALUE OF ANY IN-GAME OR ON-CHAIN ASSET, ARISING OUT OF OR RELATING TO THE GAME, HOWEVER CAUSED.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE GAME IS LIMITED TO USD 100.

Some jurisdictions do not allow these exclusions or limits, so they apply to you only as far as the law allows.

25. Indemnity

You will indemnify us against third-party claims, and reasonable legal costs, arising from your breach of these terms, from content you created or uploaded, from your infringement of someone else's rights, or from your unlawful use of the game. This does not apply to the extent the claim is caused by us.

26. Governing law and disputes

We are an independent project and have not yet incorporated, so these terms do not nominate a national law or a court. What does not change: you keep every mandatory consumer protection of the country where you live, and you may always bring a claim in the courts of that country. If we form a company we will name its governing law here and update the date at the top before it takes effect.

Before starting formal proceedings, please write to support@pixelkingdomwars.com describing the problem. We will try to resolve it within 30 days. Most disputes end there.

27. Solana dApp Store

If you obtained the game through the Solana dApp Store, this section applies.

These terms are solely between you and Pixel Kingdom Wars. Solana Mobile Inc. and its affiliates and licensors (the "Solana Mobile Parties") are not a party to these terms and have no responsibility or liability to you in connection with the game or any Solana Mobile program. We alone are responsible for the game, its content, its support and any claim relating to it.

The disclaimer of warranties in section 23 and the limitation of liability in section 24 apply to the Solana Mobile Parties as fully as they apply to us. The Solana Mobile Parties are third-party beneficiaries of these terms and may enforce them against you.

You must also comply with the Solana dApp Store Terms of Use. Where those terms and these terms conflict, those terms take precedence.

28. General

If a provision is unenforceable, the rest stands. If we do not enforce a provision, we have not waived it. These terms, together with the Privacy Policy, are the entire agreement between us about the game. We may assign these terms, for example if the game is sold; you may not. Headings are for convenience only.
